By accessing or using the DMARC Analytics service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service constitutes acceptance of any updates to these Terms.
2. Service Description
DMARC Analytics provides automated processing and visualization of DMARC aggregate reports. The Service receives DMARC reports via email, parses and stores the data, and presents analytics through a web-based dashboard. The Service is deployed on Amazon Web Services (AWS) infrastructure.
3. Limitation of Liability
To the maximum extent permitted by applicable law, DMARC Analytics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. This includes, without limitation, liability for:
- Data loss or corruption — including loss, corruption, or unavailability of DMARC report data, processed analytics, or any other data stored by the Service
- Revenue or business losses — including lost profits, business interruption, or loss of business opportunities arising from use of or inability to use the Service
- Security breaches or unauthorized access — including unauthorized access to your data, API keys, or dashboard, whether caused by vulnerabilities in the Service or by third parties
- Service interruptions or downtime — including scheduled or unscheduled maintenance, infrastructure failures, or any other cause of Service unavailability
- Accuracy of DMARC report data — the Service processes reports as received from third-party mail servers and makes no guarantees regarding the accuracy, completeness, or timeliness of the underlying report data
- Third-party services — including failures or disruptions of AWS infrastructure, email providers, DNS services, or any other third-party service on which the Service depends
In no event shall the total aggregate liability of DMARC Analytics exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
4. Warranty Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.
5. Your Responsibilities
You are responsible for:
- Maintaining the confidentiality of your API keys and access credentials
- Ensuring your DNS records are correctly configured to send DMARC reports to the Service
- Complying with all applicable laws and regulations related to your use of the Service
- Any activity that occurs under your account or API keys
6. Data and Privacy
The Service processes DMARC aggregate reports sent to it by third-party mail servers. These reports contain information about email authentication results for your domain(s), including source IP addresses, authentication outcomes, and message counts. The Service does not access or store the content of individual emails.
7. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time by cancelling your subscription. Upon termination, your right to access the Service ceases immediately. We may delete your data after a reasonable retention period following termination.
8. Indemnification
You agree to indemnify, defend, and hold harmless DMARC Analytics and its operators from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or your violation of these Terms.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
